Do federalismo de cooperação ao federalismo canibal: a Lei Kandir e o desequilíbrio do pacto federativo

Resumo
O presente artigo pretende investigar o contexto histórico de edição e aprovação da Lei Complementar nº 87/1996 (Lei Kandir), para avaliar em que medida a desoneração do ICMS nas exportações afetou o pacto federativo firmado na Constituição da República Federativa do Brasil (CRFB), de 1988. Para tanto, foram analisados registros históricos do processo legislativo do Projeto de Lei Complementar nº 95/1996, das propostas aprovadas para a alteração do art. 31 da LC nº 87/1996, da Emenda Constitucional nº 42/2003 (que elevou as desonerações ao status constitucional de imunidade) e, finalmente, do episódio mais recente dessa normatização, o julgamento da ADO nº 25 pelo Supremo Tribunal Federal. Além da investigação histórica, este estudo analisa o conteúdo jurídico-normativo do princípio federativo, cláusula pétrea da CRFB, e realiza o cotejo entre o necessário respeito a esse conceito e a prática legislativa e política no âmbito da Lei Kandir.

FROM COOPERATIVE FEDERALISM TO CANIBAL FEDERALISM: KANDIR LAW AND THE UNBALANCE OF THE FEDERATIVE PACT
ABSTRACT: This article aims to investigate the historical context of edition and approval of the Supplementary Law No. 87/1996 (Kandir Law) and to what extent the fiscal exemption to ICMS on exports has affected the federal pact established in the Brazilian Constitution from 1988. For this purpose, historical registers of the legislative process related to several bills were analyzed, including the bill drafting No. 95/1996, all the approved bills to modify the Article 31 of the Supplementary Law No. 87/1996 and the bill of the constitutional amendment No. 42/2003 (which has elevated the exemption to the constitutional immunity status). Besides the historical investigation, this study discuss the legal-normative content of the federal principle, an entrenched clause of the Constitution, and compare the legal necessity to respect this principle with the legislative and political reality in context of the Kandir Law.
