Integridade transnacional dos direitos humanos

Resumo
Este artigo busca responder à questão sobre se os tribunais ao redor do mundo devem buscar uma coerência mundial no que diz respeito à interpretação dos direitos humanos. Busca expor os argumentos e a disputa entre relativismo e universalismo dos direitos humanos. Expõe a ideia romana de “leis parcialmente comuns a toda espécie humana” usada por Jeremy Waldron em favor da invocação involuntária do direito estrangeiro por tribunais nacionais. Defende que não deve haver uma harmonização global e regional indiscutível entre todos os direitos constitucionais que correspondem aos direitos humanos. Sustenta a invocação de fontes estrangeiras e internacionais mediada por uma “margem de apreciação comparativa”, a ideia segundo a qual os tribunais devem levar a sério as características das sociedades e os aspectos situacionais dos casos concretos.

TRANSNATIONAL INTEGRITY OF HUMAN RIGHTS
ABSTRACT: This article addresses the question about whether the courts around the world should get a global coherence as regards the interpretation of human rights. It exposes the arguments and the dispute between universalism and relativism of human rights. It explains the Roman idea of partly laws common to all mankind used by Jeremy Waldron in favor of involuntary invoking of foreign law by national courts. It argues that there should not be a global and regional harmonization undebatable among all the constitutional rights that correspond to human rights. It defends that the invocation of foreign and international law sources should be mediated by a “comparative margin of appreciation”, the idea that the courts should take seriously the specific features of societies and situational aspects of specific cases.
