Dois conceitos de Ética e alguns de seus reflexos na Filosofia do Direito

Resumo
O presente artigo pretende examinar o conceito de ética em Lima Vaz e em Jürgen Habermas, bem como verificar, por meio da metodologia hipotético-dedutiva, alguns dos reflexos dessas duas formas de conceituar ética na Filosofia do Direito. Para Lima Vaz, a ética é a ciência do ethos, ou seja, dos costumes e hábitos. Para Jürgen Habermas, a ética diz respeito ao entendimento coletivo consciente de tradições e valores (o que é bom para o grupo), diferentemente da moral, que está relacionada a interesses de todos os seres humanos (o que é bom para a humanidade). Embora diferentes, as duas concepções reforçam a relevância da ética para a compreensão do Direito nas sociedades contemporâneas em razão da tendência de se vincular o que é bom para a comunidade ética às leis.

Two concepts of ethics and some of their reflections in the Philosophy of Law
This article intends to present two different ways of conceptualizing ethics, as well as some of their reflections in the Philosophy of Law. The hypothetical-deductive methodology will be used, examining, on the one hand, the concept of ethics in Lima Vaz and, on the other, the concept of ethics in Jürgen Habermas, in order to verify some of their reflections in the Philosophy of Law. For Lima Vaz, ethics is a science that handles ethos, that is, customs and habits. For Jürgen Habermas, ethics concerns the conscious collective self-understanding of our traditions and values (being related to what is good for the group), unlike morality, it is related to the interests of all human beings (being therefore related to what is good for humanity). Although different, these conceptions of ethics reinforce the relevance of ethics in the understanding of law in contemporary societies, due to the existing intention to link what is good for the ethical community to the Law.
