O bitcoin é um valor mobiliário ou um ativo financeiro?

Resumo
Analisa-se se o bitcoin pode ser juridicamente definido no Brasil como um valor mobiliário. Com base em pesquisa bibliográfica e método dedutivo, parte-se da constatação de que a definição do regime jurídico aplicável ao bitcoin permitirá a futura identificação do regime jurídico aplicável aos demais criptoativos e à sua distribuição pública (as Initial Coin Offerings (ICOs)). O presente trabalho está dividido em três partes além da introdução, da conclusão e das referências bibliográficas: 1. O que é o bitcoin?, 2. O bitcoin é um valor mobiliário? e 3. O bitcoin é um ativo financeiro?. O texto conclui que o bitcoin não é um valor mobiliário nem um ativo financeiro e, portanto, está fora do perímetro regulatório do órgão regulador do mercado de capitais brasileiro.

Is bitcoin a security or a financial asset?
This article analyzes whether bitcoin could be considered a security or a financial asset in Brazil. Based on bibliographical research and on the deductive method, the article draw conclusions considering that the definition of the legal and regulatory regime applicable to bitcoin will enable the future identification of the legal regime applicable to other crypto-assets and to their Initial Coin Offerings (ICOs). The present article is divided into three parts besides the introduction, the conclusion and the bibliographical references: 1. What is bitcoin?, 2. Is bitcoin a security? and 3. Is bitcoin a financial asset?. The article concludes that bitcoin is neither a security nor a financial asset and, therefore, is outside the regulatory space of the Brazilian Securities and Exchange Commission.
