Medidas constitucionais de restauração da ordem pública: reflexões sobre a intervenção federal e os estados de defesa e de sítio

Resumo
O estudo apresenta algumas considerações sobre as medidas constitucionais de restauração da ordem pública, tema que costuma gerar algumas dificuldades entre os que estudam o Direito Constitucional. Para isso, primeiramente avalia em que consiste a ordem pública, suas manifestações em diversos ramos do Direito, sua relação com as instituições, a crise constitucional e a crise constituinte; em seguida, apresenta a ideia de estado de exceção, com base nas obras de Reinach, Schmitt e Agamben, para num terceiro momento analisar o regramento das medidas constitucionais de restauração da ordem – a intervenção federal, o estado de defesa e o estado de sítio –, bem como ponderar se tais medidas consistem em estados de exceção. O estudo dialoga com autores clássicos sobre o tema, estabelecendo uma interface com os fatos políticos e sociais.

Constitutional measures for the restoration of public order: reflections on federal intervention and the states of defense and siege
The paper presents some considerations on constitutional measures for the restoration of public order, a topic that usually generates some difficulties among those who study Constitutional Law. The study evaluates, at first, the meaning of public order, in its manifestations in various legal disciplines, and in its relationship with institutions, the constitutional crisis and the constituent crisis; then, it presents the idea of state of exception, based on the works of Reinach, Schmitt and Agamben, to, in a third moment, analyze the constitutional regulation of the measures for the restoration of public order, namely: federal intervention, the state of defense, and the state of siege; and reflect whether such measures consist of states of exception, or not. The study dialogues with classic authors on the subject, establishing a dialogue with political and social facts.
