O ativismo judicial à luz do pensamento de Konrad Hesse sobre a força normativa da Constituição

Resumo
O advento do Estado Constitucional de Direito trouxe como consequência o reconhecimento da força normativa da Constituição e a expansão da jurisdição constitucional. Esta pesquisa verifica se a força normativa da Constituição, defendida por Konrad Hesse, abriu espaço para o ativismo judicial. Para isso, desenvolveu-se pesquisa bibliográfica de natureza qualitativa. Inicialmente, busca-se entender o que é considerado ativismo judicial e a sua distinção em relação à judicialização da política. Depois, revisita-se a teoria da força normativa da Constituição de Konrad Hesse e, ao final, conclui-se que a força normativa da Constituição não abriu caminho para a postura ativista do Poder Judiciário.

Judicial activism in the light of Konrad Hesse’s thought regarding the normative force of the Constitution
The advent of the constitutional rule of law brought a result of the recognition of the Constitucion normative force and the expansion of constitutional jurisdiction. It must be ascertained, in this research, the Constitucion normative force, defended by Konrad Hesse, opened space for judicial activism. To reach it, it developed literature and qualitative research. Initially, search to understand what is considered judicial activism and the distinction from the politics judicialization. Then, revisits the theory of Constitucion normative force of Konrad Hesse and, at the end, it is concluded that the Constitucion normative force did not open the way for the activist judiciary posture.
