A vinculação do precedente judicial e a segurança jurídica

Resumo
O principal objetivo deste estudo consiste em refletir sobre a adoção de uma teoria dos precedentes judiciais vinculantes no ordenamento jurídico brasileiro como forma de garantir o princípio constitucional da segurança jurídica. Para tanto, analisa-se o precedente judicial e a sua estrutura, buscando a compreensão do instituto. Para manter a coerência da aplicação dos precedentes judiciais e a própria dinâmica do Direito, pesquisou-se sobre as técnicas de redação, interpretação e superação dos precedentes para compreender de que forma um sistema de precedentes obrigatórios pode garantir o princípio constitucional da segurança jurídica. Em seguida, examinou-se a leitura tradicional do princípio da segurança jurídica, abordando seus principais aspectos e dimensões. Por fim, com fundamento em tais premissas, propõe-se uma releitura do princípio da segurança jurídica, frisando a necessidade de sua aplicação durante o exercício da atividade jurisdicional.

THE JUDICIAL PRECEDENT BINDING EFFECT AND LEGAL CERTAINTY
ABSTRACT: The main objective of this study is to reflect the adoption of a theory of binding judicial precedents in the Brazilian legal system as a way of guaranteeing the constitutional principle of legal certainty. For this, the judicial precedent and its structure are analyzed, seeking the understanding of the institute. In order to maintain consistency in the application of judicial precedents and the dynamics of law itself, the techniques of drafting, interpreting and overcoming precedents have been investigated to understand how a system of mandatory precedents can guarantee the constitutional principle of legal certainty. Next, the traditional reading of the principle of legal certainty was examined, addressing its main aspects and dimensions. Finally, based on such premises, it is proposed to re-read the principle of legal certainty, stressing the need for its application during the exercise of the jurisdictional activity.
