A importância teórica e prática da norma fundamental

Resumo
Este trabalho exporá breves notas acerca da importância teórica e prática do conceito de norma fundamental como elemento estruturante de todo o sistema da Teoria Pura do Direito desenvolvido por Hans Kelsen no princípio do século XX. De início, será pontuada a posição da Teoria Geral das Normas no contexto da produção de Kelsen, como obra que congrega textos esparsos oriundos de distintos momentos de seu trabalho intelectual, os quais não necessariamente refletem de modo uniforme o pensamento do autor naquela que ficou conhecida como sua fase “cética” ou “crítica”, iniciada após 1960, com a edição da segunda versão da Teoria Pura do Direito. No entanto, além das reconhecidas dificuldades histórico-filológicas no tratamento das fontes, pretende-se demonstrar alguns impactos teóricos e práticos desse conceito basilar para a prática judiciária, com o objetivo de realçar a importância da Teoria Geral do Direito como campo de sustentação metodológica para as demais disciplinas da ciência jurídica.

THE THEORETICAL AND PRACTICAL RELEVANCE OF THE BASIC NORM
ABSTRACT: The present paper aims to expose some brief appointments concerning the theoretical and practical relevance of the concept of the basic norm, which works as a founding element of the famous jurisprudence system developed by jurist Hans Kelsen in the beginning of the twentieth century, entitled Pure Theory of Law. At first, the problematic position of the General Theory of Norms in the context of Kelsen´s intellectual itinerary will be highlighted, in order to find a collection of scattered texts, based on different moments of the reflections proposed by the author along his life. A selection which doesn´t necessarily depicts the vision endorsed by Kelsen after 1960 and the second edition of the Pure Theory of Law, in the course of his so called “skeptical” or “critical” phase. Nonetheless, stepping for a moment beyond the aforementioned difficulties of historical and philological nature, we intent to demonstrate some theoretical and practical impacts of such a fundamental kelsenian concept to the daily practice of law, all in order to highlight the major significance of Jurisprudence as the methodological basis of all the other juridical disciplines that compose the science of law as a whole.
