Arqueologia do imaginário simbólico-jurídico: o crucifixo e a construção da legitimidade tradicional da jurisdição

Resumo
Este trabalho investiga a arqueologia do uso dos crucifixos em jurisdições medievais e aborda a repercussão desse emprego nos tribunais brasileiros. Com base na decisão do Supremo Tribunal Federal (STF) sobre a manutenção dos crucifixos em edifícios públicos, o artigo propõe-se apresentar outro argumento para defender a adequação da decisão do STF: a manutenção dos crucifixos é elemento iconológico ligado à autonomia de julgar da jurisdição, e não apenas símbolo de caráter religioso. Com metodologia de trabalho proveniente da iconologia jurídica e de estudos de Robert Jacob e de Georges Martyn, o texto situa-se no campo da História do Direito, e não do Direito Constitucional ou da Teoria do Direito, como a princípio se poderia imaginar. Conclui-se que o uso dos crucifixos decorre de legitimação jurídica e não religiosa nos tribunais.

Archaeology of the Symbolic-Legal Imaginary: The Crucifix and the Construction of the Traditional Legitimacy of Jurisdiction
This paper investigates the archaeology of the use of crucifixes in medieval jurisdictions and addresses the repercussions of this use in Brazilian courts. Based on the decision of the Brazilian Supreme Court (STF) on the maintenance of crucifixes in public buildings, the article proposes to present another argument to defend the adequacy of the STF’s decision: the maintenance of crucifixes is an iconological element linked to the jurisdiction’s autonomy to judge, and not just a symbol of a religious nature. With a work methodology derived from legal iconology and studies by Robert Jacob and Georges Martyn, the text is situated in the field of History of Law, and not Constitutional Law or Legal Theory, as one might initially imagine. It is concluded that the use of crucifixes derives from legal and not religious legitimacy in the courts.
