Resumo
Este estudo descritivo visa precisar o conteúdo normativo dos direitos fundamentais à vida e à integridade, bem como suscitar questões relativas à autonomia do sujeito, como o autossacrifício, a eutanásia, a automutilação e a vacinação compulsória. Os direitos à vida e à integridade definem-se negativamente em relação à não agressão e positivamente à promoção de condições adequadas. Eles devem ser compreendidos sob a perspectiva tanto do próprio sujeito quanto do objetivo, da qual decorrem deveres de proteção pelo Estado e pela sociedade, além de um alto grau de indisponibilidade. É importante definir o início e o fim da proteção jurídica à vida e à integridade. A pena de morte é admitida excepcionalmente, ao passo que a vedação à tortura é absoluta. Realizou-se uma abordagem dedutiva baseada em pesquisa bibliográfica de legislação e jurisprudência.

Right to life and right to integrity
This descriptive study aims to clarify the normative content of the fundamental rights to life and integrity, as well as to raise questions related to the autonomy of the person, such as self-sacrifice, euthanasia, self-mutilation and compulsory vaccination. The rights to life and integrity are defined negatively, in relation to non-aggression, and positively, in the sense of promoting adequate conditions. They must be understood both from the person’s own perspective and from an objective perspective, from which the State and society must provide protection, and from which non-disposable rights stem. It is important to define the beginning and the end of legal protection for life and integrity. While the death penalty is exceptionally permitted, torture is prohibited. A deductive approach was carried out, based on bibliographic research, legislation and jurisprudence.
