Resumo
O artigo apresenta as principais perspectivas teóricas sobre o argumento da intenção do legislador, sistematiza a evolução do debate em torno de seu significado e uso – com foco no contexto europeu e norte-americano – e explica qual é a compreensão atual do tema. O trabalho está dividido em introdução, uma seção sobre o papel da intenção do legislador na interpretação jurídica, uma seção dedicada às situações em que seria possível afastar-se da intenção legislativa e na conclusão, em que se retomam as ideias mais importantes trabalhadas no texto.

The legislator’s intent argument: theoretical annotations on use and meaning
The article presents the main theoretical ideas about the argument of the legislator’s intent, systematizing the evolution of the debate around its meaning and use – focusing on the European and North-American context – and explaining what is its current understanding. The paper is divided into an introduction, a section dealing with the theoretical perspectives on the role of the legislative intent in legal interpretation, a section dedicated to the situations in which it would be possible to depart from the legislative intention, and a conclusion, in which the most important ideas worked on in the text are resumed.
