Resumo
O artigo objetiva analisar o princípio da imparcialidade do juiz no Direito brasileiro e no alemão, bem como sua concretização, no segundo, em casos de relacionamento pessoal ou relação de parentesco entre juiz e advogado. Trata-se, portanto, metodologicamente, de um estudo de Direito Comparado. A análise abrange o conteúdo, a validade nos sistemas jurídicos brasileiro e alemão, a correção prática geral e a classificação normativa do princípio da imparcialidade do juiz. Demonstra-se que, do ponto de vista da moderna teoria dos princípios, o “princípio” da imparcialidade do juiz deve ser classificado como uma regra, não como princípio. Em seguida, são estudadas as medidas adotadas pelo Direito alemão vigente para a efetivação do princípio da imparcialidade do juiz nos casos em que existe relacionamento entre juiz e advogado. A análise mostra que na Alemanha os meios processuais são suficientes para implementar o princípio da imparcialidade do juiz.

Challenging the judge on grounds of bias by virtue of personal or family relationship with the lawyer in German Law
This article aims to analyse the principle of the impartiality of the judge both in Brazilian and German legal systems and its application, in German law, in cases of personal or family relationship between the judge and the lawyer. Thus, it is, methodologically, an essay of Comparative Law. The analysis comprises the content, the validity both in the Brazilian and German legal systems, the practical correction and the normative classification of the principle of the impartiality of the judge. It is shown that, from the standpoint of the modern theory of principles, the “principle” of the impartiality of the judge must be classified as a rule, and not as a principle. After that, the means adopted by current German law in cases in which there is a relationship between the judge and the lawyer are studied. These means are, in Germany, enough to implement the principle of the impartiality of the judge.
