A sistemática de conteúdo local e a cooperação entre TCU e ANP: um passo importante rumo à coerência regulatória

Resumo
O Tribunal de Contas da União realizou auditoria operacional para avaliar a Política de Conteúdo Local nas licitações do mercado de petróleo e gás, bem como as implicações e os impactos da ausência de regulamentação adequada sobre o tema dentro da Agência Nacional de Petróleo, Gás Natural e Biocombustíveis. Esse Tribunal fez recomendações e determinações à Agência e ao Ministério de Minas e Energia, e acabou por contribuir de forma efetiva para o aprimoramento regulatório da matéria. Investiga-se, no presente artigo, se é possível haver uma atuação coordenada de um agente regulador e seu controlador ou se, invariavelmente, pode-se pressupor certa dose de conflito entre eles.

The local content system and the cooperation between TCU and ANP: an important step toward regulatory coherence
The Audit Court of the Union has carried out an operational audit in order to evaluate the Local Content Policy in the oil and gas market bids, as well as the implications and impacts of the absence of adequate regulation on the subject within the National Agency for Petroleum, Natural Gas and Biofuels. The Court has made recommendations and determinations to the Agency and the Ministry of Mines and Energy and ended up by effectively contributing to the regulatory improvement of the matter. This paper investigates whether it is possible to have a coordinated action of a regulating agent and its controller, or if invariably one can assume a dose of conflict between them.
