Resumo

No presente artigo, examina-se a questão da eficácia subjetiva de sentenças coletivas proferidas em ações civis coletivas, com base no art. 16 da Lei nº 7.347/1985 e na jurisprudência do Supremo Tribunal Federal (STF) e do Superior Tribunal de Justiça (STJ). Considerando que essa questão será objeto de análise pelo STF em Recurso Extraordinário com repercussão geral reconhecida, recordam-se os critérios de legitimação das entidades de classe para a defesa coletiva de direitos e os conceitos e distinções entre direitos difusos, coletivos e individuais homogêneos. Por fim, defende-se a necessidade de retificação do entendimento jurisprudencial do STJ, com a limitação dos efeitos subjetivos das sentenças coletivas nos exatos termos do art. 16 da Lei nº 7.347/1985.

The subjective strength of sentences in class actions in the light of Teori Albino Zavascki’s doctrine: the state of art of case law in Superior Court of Justice of Brazil

This article aims to examine the subjective effectiveness of collective sentences issued in class action law suits within civil law, based on section 16 of act number 7347 of 1985 as well as the caselaws from the Federal Supreme Court (STF) and the Superior Court of Justice (STJ). Considering that this issue will be analyzed by STF, in an Extraordinary Appeal with recognized general repercussion, the criteria for legitimizing class entities for the collective defense of rights and the concepts and distinctions between diffuse, collective and homogeneous individual rights are regarded. Finally, the need to rectify STJ’s understanding is defended, with the limitation of the subjective effects of collective sentences, in the exact terms of said act.
