Religião em Direito Comparado e a ampliação de seus limites: a metodologia dialógica entre Teologia e Direito

Resumo
O mapa atual em Direito Comparado e religião funda-se em abordagens de sobreposição de sistemas legais, limitando o quefazer jurídico no campo da religião ao método de comparação legal. Esse estudo comparativo desconsidera que, ao longo da história, as tradições religiosas foram as bases dos sistemas jurídicos atuais. O objetivo do presente artigo é analisar a metodologia do Direito Comparado no que se refere à religião e propor o saber teológico como uma das fontes para a leitura e interpretação desse campo de estudo. A pesquisa é qualitativa, de caráter explicativo e teórico; a metodologia, bibliográfica e documental. Com base na análise do tema, propõe-se a aplicação da metodologia dialógica, com o propósito de ampliar o ensino do Direito Comparado e integrá-lo com as inovações e avanços das ciências teológicas.

Religion in comparative law and its broadening of the limits: the dialogical methodology between theology and law
The current map in comparative law and religion is based on approaches of overlapping legal systems, limiting the legal task, in the field of religion, to the method of legal comparison. The comparative study disregards the fact that, throughout history, religious traditions have often been the basis for current legal systems themselves. The objective of this article is to analyze the methodology of comparative law and religion and to propose theological knowledge as one of the sources for the reading and interpretation of dialogical comparative law. The methodology is bibliographic and documentary, explanatory, qualitative and theoretical in nature. By analyzing the theme, the dialogical methodology is applied in the field of comparative law and religion, and its teaching method is expanded in the wake of integration, collaboration and innovation, with advances in the theological sciences.
