A doutrina da margem de apreciação e a educação sexual: Interights vs. Croácia

Resumo
A doutrina da margem de apreciação foi criada nos anos 60 pelo Tribunal Europeu de Direitos Humanos com base no reconhecimento de que, em casos envolvendo diretamente os valores culturais de determinada sociedade, o tribunal nacional está em melhores condições de decidir do que o tribunal internacional. Nessa linha, o presente artigo objetiva evidenciar a contribuição dessa doutrina na harmonização dos ordenamentos jurídicos internacionais e nacionais, em tempos em que os sistemas internacionais de proteção dos direitos humanos vêm ampliando sua atuação e levantando questionamentos sobre seus efeitos homogeneizantes. Para tal, escolheu-se o método de estudo de caso, optando-se por Interights vs. Croácia, sobre educação sexual e reprodutiva, decidido pelo Comitê Europeu de Direitos Sociais, em 2009. Ao final, verificou-se que, nesse caso, o uso da doutrina da margem de apreciação pelo Comitê permitiu salvaguardar os direitos envolvidos, sem que os valores culturais da sociedade croata fossem atingidos.

The margin of appreciation doctrine and sexual education: Interights v. Croatia
The margin of appreciation doctrine was created in the 1960s by the European Court of Human Rights from the recognition that, in cases directly involving the cultural values of a particular society, the national court is better able to rule than the international court. In this line, this article aims to highlight the relevance of this doctrine in the harmonization of international and national legal systems, at a time when international systems for the protection of human rights have been enhancing its performance and raising questions about its homogenizing effects. For this, we chose the case study method, selecting Interights v. Croatia, on sexual and reproductive education, decided by the European Committee on Social Rights in 2009. In the end, it was found that the Committee’s use of the margin of appreciation doctrine, in this case, allowed to safeguard the rights involved, without the cultural values Croatian society were hit.
