A nova inviolabilidade parlamentar: um estudo de sua construção jurisprudencial no Brasil

Resumo

Este artigo pretende apresentar as sucessivas transformações jurisprudenciais que sofreu o instituto da inviolabilidade parlamentar no Brasil, com base nas decisões do Supremo Tribunal Federal, e o que esse instituto representa atualmente no País. Para isso, apresentamos o contexto histórico em que surgiram as chamadas “imunidades parlamentares”, remontadas à Revolução Francesa e ao Bill of Rights inglês, e discorremos acerca de suas duas modalidades: a “inviolabilidade” e a “irresponsabilidade”. Em seguida, é traçada a evolução histórica dessas garantias ao longo das diversas Constituições brasileiras, chegando ao regramento da matéria no art. 52 da Constituição de 1988. Com base nesse arcabouço, comentamos as sucessivas interpretações realizadas pelo Supremo Tribunal Federal a partir de 2006, que ampliaram os poderes da Corte para determinar medidas cautelares penais contra parlamentares, e apresentamos o que chamamos de “nova inviolabilidade parlamentar”, fruto da sua jurisprudência.

The new freedom from arrest: an study of its jurisprudential construction in Brazil

This article aims to present the successive jurisprudential transformations that happened to the parliamentary freedom from arrest in Brazil, caused by decisions of the Supremo Tribunal Federal, and what actually means this guarantee in our country. To reach this purpose, we start with the historical context in which appeared the so called “parliamentary immunities”, back to French Revolution and the English Bill of Rights, and we talk about its two categories: the “freedom from arrest” and the “freedom of speech”. After that, we draw the historical evolution of these guarantees over the Brazilians constitutions until its regulation on the article 52 of the 1988 Constitution. From this framework, we comment the successive interpretations made by the Supremo Tribunal Federal from 2006, which successively enlarged the powers of the court to determine criminal measures against members of parliament, and we show what we call “new freedom from arrest”, which is a result of the STF’s jurisprudence.
