O papel da lei no século XXI à luz da cibernética

Resumo
Com as novas tecnologias de comunicação, redes informais tornam-se ainda mais fluidas e aumentam os custos do Estado para evitar que a lei seja burlada por núcleos descentralizados. Baseado na teoria cibernética, este artigo propõe que, em última instância, a noção de lei seja instrumento disciplinador de uma ordem social bem-sucedida na relação entre o Estado e demais grupos centralizados. Caso contrário, a lei deve ser considerada somente um conjunto de incentivo entre outros fatores que influenciam a ação individual. Por meio de uma revisão da literatura sobre cibernética e complexidade, uma visão geral do movimento cypherpunk e estudos de casos de conflitos na governança de duas grandes blockchains, esboçamos a ideia de leis e políticas públicas como ferramentas para incentivar positivamente atores sociais em vez de discipliná-los.

Cybernetics and legislation in 21th century
Due to new communication technologies, informal networks become even more fluid and the costs for the state to enforce the Law upon decentralized entities increase. Based on the cybernetic theory, this paper discusses the Law as a disciplining instrument of social order successful only when shaping the relationship between the state and other centralized groups. Else, the Law should be considered just as a set of incentives among many other factors influencing individual action. Through a review of the literature on cybernetics and complexity, an overview of the cypherpunk movement, and case studies of clashes in the governance of two large blockchains, we sketch the idea of laws and policies as tools to incentive individual actors rather than to discipline them.
