Integridade, justiça e constrições institucionais em Law’s Empire

Resumo
Em Law’s Empire, Ronald Dworkin elabora sua famosa teoria do Direito como integridade. No último capítulo do livro, introduz uma importante distinção entre integridade pura e integridade inclusiva. Neste artigo, analiso a distinção entre elas e elucido como a ideia de integridade inclusiva explica a relevância da história institucional de uma comunidade para o conteúdo do Direito. Essa relevância explica por que o conteúdo do Direito não é determinado exclusivamente pelos valores da integridade pura, e também por que os juízes estão sujeitos a constrições institucionais, sem que, no entanto, valores de moralidade política deixem de ser relevantes para o conteúdo dos seus deveres. Ao final, utilizo essa distinção para responder à crítica de Joseph Raz ao papel da coerência no Direito. Argumento que a crítica de Raz não leva em consideração o papel da integridade inclusiva e pressupõe a verdade da tese da autoridade, rejeitada por Dworkin.

INTEGRITY, JUSTICE AND INSTITUTIONAL CONSTRICTIONS IN LAW’S EMPIRE
In Law’s Empire, Ronald Dworkin developed his famous theory of law as integrity. In the last chapter of the book, Dworkin introduces an important distinction between pure integrity and inclusive integrity. In this article, I analyse the distinction between the two, and explain how the idea of inclusive integrity explains the relevance of the institutional history of a community to the content of the law. This relevance explains why the content of the law is not determined exclusively by the values of pure integrity, and also, why the judges are subject institutional constraints, without, however, values of political morality ceasing to be relevant to his duty. In the end, I use this distinction to respond to Joseph Raz’s criticism of the role of coherence in law. I argue that this criticism does not take into account the role of inclusive integrity and assumes the truth of the authority thesis, rejected by Dworkin.
