Pressupostos do constitucionalismo ambiental

Resumo
As várias transformações que caracterizaram o Direito Constitucional após a Segunda Guerra Mundial incorporaram ao constitucionalismo a realização da pessoa humana e a preservação do meio ambiente. Ao lado de outras transformações, esses dois elementos deram origem ao constitucionalismo ambiental e, assim, a uma nova forma de entender a Constituição e o Estado. Este pequeno artigo se propõe a analisar alguns desses novos elementos e situá-los ao lado de ideias tradicionais que giram em torno do conceito de constitucionalismo e das quais ele depende. O conjunto desses elementos novos e tradicionais foi aqui denominado pressupostos do constitucionalismo ambiental.

CONSTITUTIONALISM ENVIRONMENTAL ASSUMPTIONS
ABSTRACT: Several transformations that characterized the constitutional law after the Second World War brought to constitutionalism the fulfillment of the human person and the preservation of the environment. Alongside other changes, these two elements gave rise to environmental constitutionalism and thus a new way of understanding the constitution and the state. This short paper aims to analyze some of these new elements and place them next to traditional ideas that revolve around the concept of constitutionalism and of which it depends. The set of all of them was called here constitutionalism environmental assumptions.
