A metamorfose do patrimônio cultural até a Assembleia Nacional Constituinte de 1987

Resumo
Pressupondo que, além de direito fundamental, o patrimônio cultural é a proteção de uma memória construída e selecionada a partir de fatos ideologicamente relevantes e determinantes para um determinado grupo manter-se no Poder, este texto trará a discussão em torno dos termos “kultur” e “civilização” e da importância dessa distinção para a lógica da proteção imaterial. Discutiremos também o desenvolvimento da proteção cultural imaterial até a Constituinte de 1987, passando por Rodrigo Franco e Aloísio Magalhaes à frente dos institutos protetivos, e estabeleceremos os reflexos dessa “evolução” sobre a proteção cultural imaterial na Constituição Federal de 1988.

THE METAMORPHOSIS OF CULTURAL HERITAGE UNTIL THE NATIONAL CONSTITUENT ASSEMBLY 1987
ABSTRACT: Assuming that, in addition to fundamental rights, cultural heritage is the protection of a built memory selected from ideologically relevant facts decisive for a certain group to remain in power, this text will bring the discussion around terms “kultur” and “civilization” and discuss how important is the difference between these two terms for immaterial protection logic. It will also present intangible cultural protection development until the National Constituent Assembly of 1987, via protective institutes’ leadership of Rodrigo Franco and Aloisio Magalhaes, and define the contours of this “evolution” compared to current constitutional protection.
