Eficácia dos direitos fundamentais nas relações interprivadas: o estado da questão

Resumo
A problemática concernente à eficácia dos direitos fundamentais nas relações entre particulares, própria da emergência das democracias constitucionais no pós-segunda guerra mundial, está no cerne de intermináveis debates respeitantes à precisão de seu alcance. O problema teórico, de fundamentação dessas posições jurídicas intangíveis, é obnubilado pelo problema prático, de sua aplicação. Nesse quadrante, plúrimas são as estratégias argumentativas voltadas à defesa de diferentes calibres para a autoridade dos direitos fundamentais nas relações interprivadas. O presente trabalho escrutina as principais correntes na literatura continental e, após contrastá-las e pô-las ao teste do ceticismo, aponta aquela orientação que, no atual estado da arte, melhor exprime a solução a ser, tópica e sistematicamente, construída pela atividade hermenêutica.

THIRD-PARTY EFFECT OF FUNDAMENTAL RIGHTS: THE STATE OF THE QUESTION
ABSTRACT: Third-party effect of fundamental rights is one of the most hi-falutin issues arising from the emergence of constitutional democracies in the second post-war. The extent to which fundamental rights bind private parties is in the center of unending jurisprudential debates. The so-called theoretical problem, concerning the raison d’être of such intangible provisions, is clouded by a practical issue, which respects their application. In this scenario, multiple strategies advocate different measures for the authority of fundamental rights upon private relations. This article scrutinizes the mainstream orientations on these matters in the light of continental literature and, after contrasting them all and subjecting them to a skeptic test, points out the opinion that, in the context of the contemporary state of the question, best indicates the solution to be topic and systematically pursued by hermeneutics.
