Estado prestador versus Estado regulador: um diagnóstico do direito social à saúde no Brasil

Resumo

É universal o desafio de promover o direito à proteção à saúde, e ela tem sido um dos principais problemas da socialidade. O objetivo do presente estudo é demonstrar e retratar as novas funções do Estado regulador também na promoção do direito fundamental à saúde, utilizando-se como referência o contexto brasileiro. É analisada, com base em exemplos concretos, a atuação reguladora, garantidora e incentivadora do Estado na promoção da saúde.

STATE PROVIDER VERSUS REGULATORY STATE: A DIAGNOSIS OF THE SOCIAL RIGHT TO HEALTH IN BRAZIL

ABSTRACT: The challenge of promoting the right to health protection is universal and features one of the main problems of sociality in today’s context. The aim of this study is to demonstrate and portray the new regulatory state functions regarding to the promotion of the fundamental right to health, using as reference the Brazilian context. The regulatory role of the state in health care systems, in its many aspects, is also studied.
