Forum shopping, fenômeno jurídico do cenário pós-Guerra Fria

Resumo
O presente artigo tem o propósito de demonstrar como a ordem internacional pós-Guerra Fria promoveu o fenômeno jurídico denominado forum shopping. Analisando as principais alterações ocorridas no contexto internacional desde 1990, é possível averiguar a incapacidade das organizações e das instituições multilaterais tradicionais em solucionar as demandas apresentadas por novas potências mundiais e por outros atores internacionais. Desse modo, diversas coalizões ad hoc e novos órgãos jurisdicionais surgiram em resposta à crescente insegurança política e jurídica do contexto internacional. Com um maior número de atores estatais e não estatais acessando uma quantidade crescente de tribunais e cortes internacionais, estratégias de forum shopping emergiram no âmbito global.

FORUM SHOPPING, A JURIDICAL PHENOMENON OF THE POST-COLD WAR CONTEXT
ABSTRACT: This article aims to demonstrate how the Post-Cold War international order triggered the juridical phenomenon called forum shopping. By analyzing the main transformations occurred in the international context since 1990, it was possible to notice how traditional multilateral organizations and institutions were unable to offer appropriate solutions to the demands posed by new world powers and new international actors. Thus, in the international context, diverse ad hoc coalitions and different jurisdictional courts and tribunals arise as an answer to the increasingly political and juridical uncertainness. With more States and non-states actors having access to different sorts of international tribunals and courts, forum shopping strategies emerged in the global scope.
