Ativismo judicial ou contrarrevolução jurídica? Em busca da identidade social do Poder Judiciário

Resumo
O artigo aborda uma relação que deve existir entre a própria identidade social do Poder Judiciário e sua atuação. A constituição histórica do Poder Judiciário no Brasil representa mais que uma curiosidade do passado. A historicidade pode fornecer-nos muitas respostas sobre problemas do presente. Nessa medida, a captura do Judiciário pelas elites representa uma constituição de sentido de sua atuação. Analisamos, então, se o Poder Judiciário pode ser considerado um poder ativista ou se atua contrarrevolucionariamente. As conclusões podem vir por meio da filosofia hermenêutica de Heidegger.

JUDICIAL ACTIVISM OR LEGAL COUNTERREVOLUTION? IN SEARCH OF SOCIAL IDENTITY OF THE JUDICIARY
ABSTRACT: The article discusses a necessary relationship that must exist between the social identity of the Judiciary and its operations. The historical constitution of the judiciary in Brazil is more than a curiosity of the past. The historicity can give us many answers about this problem itself. As such, the capture of the judiciary by elites is a constitution of its own actuation direction. Analyzed, then the judiciary can be had as an activist power or acts counterrevolutionary. The answers can be completed through the hermeneutic philosophy of Heidegger.
