O caráter dinâmico dos regimentos internos das Casas Legislativas

Resumo
Este estudo objetiva investigar as concepções relativas à natureza das normas regimentais, para responder à seguinte questão: qual é a dimensão da autonomia do Poder Legislativo para a autonormatização diante da acentuada constitucionalização do direito parlamentar no Estado Democrático de Direito? É necessário, pois, verificar os contornos da independência do Poder Legislativo nessa matéria, para colmatar a disciplina constitucional referente ao funcionamento adequado às vicissitudes do funcionamento parlamentar. O entendimento da rigidez constitucional em torno do direito parlamentar, supostamente calcado na supremacia da Constituição, conduz à forte limitação do Poder Legislativo para disciplinar internamente as minúcias do procedimento legiferante, levando em conta os aspectos da dinamicidade inerente aos processos políticos. Essa característica deve ser compatibilizada com o paradigma do Estado Democrático de Direito, evitando-se a rigidez dos regimentos internos no sentido de dificultar as adequações pontuais que possam acarretar a alteração ou o afastamento circunstancial de determinada norma regimental.

THE DYNAMIC CHARACTER OF THE INTERNAL REGULATIONS OF THE LEGISLATIVE HOUSES
ABSTRACT: The present study intends to investigate the conceptions about the nature of the parliamentary internal rules in order to face the question-problem: in what extent the legislative power has the autonomy and independence of self regulation in the face of surplus constitutionalization of the parliamentary law inside of paradigm of the democratic state? It is necessary, before that, to examine the contours of legislative power independence on self regulation to complement the constitutional discipline regarding the procedure and internal functioning, in attention of the dynamics and vicissitudes of the parliamentary functioning. The understanding of the constitutional rigidity around the parliamentary right allegedly established by the supremacy of the Constitution, leads, in fact, to the strong limitation of the Legislative Power in respect of the autonomy to discipline internally on the details of the laws formation procedure, taking into account the aspects of the dynamics inherent in political processes. The dynamism inherent to the Parliament functioning must be made compatible with the paradigm of democratic state, avoiding the rigidity of the internal regulations in order to make difficult – for not to say make impracticable – the timely and opportune adjustments to the political situation that may come, even, to imply in the circumstantial modification or removal of certain regimental rule.
