Poder Legislativo e dinâmica constitucional: um estudo à luz do princípio federativo

Resumo
O trabalho analisa as relações entre o federalismo e o Poder Legislativo no Brasil. Para tanto, avalia as distorções que se verificam na estrutura do Poder Legislativo federal, nas competências que lhe são conferidas constitucionalmente e na própria dinâmica da atividade legislativa. Destaca a mitigação do papel do Senado como a Casa de representação dos Estados-membros. Estuda, ainda, a excessiva concentração de matérias na esfera federal e o tolhimento da autonomia dos Poderes Legislativos dos Estados e dos Municípios pelo influxo do princípio da simetria.

LEGISLATIVE POWER AND CONSTITUTIONAL DYNAMICS: AN STUDY FROM FEDERALISM PERSPECTIVE
ABSTRACT: This article examines the relationship between federalism and the legislature in Brazil. It examines distortions that occur in the structure of the federal legislature, in the powers conferred constitutionally and in the dynamics of legislative activity. It discusses how the role of the Senate as a house of representation of Member States has been mitigated, highlights the excessive concentration of legislative powers at the federal level and the suffocation of the autonomy of the state and municipal legislatures by the influx of the principle of symmetry.
