A proteção internacional dos migrantes ambientais

Resumo
Este artigo visa a analisar o regime de proteção jurídico aplicável à situação de indivíduos que migram devido a fatores ambientais e a adequação de tal regime. A fim de fazê-lo, avaliaremos as normas convencionais e costumeiras aplicáveis do direito internacional dos direitos humanos, por meio de estudo da jurisprudência de tribunais internacionais, bem como de medidas específicas tomadas pela Finlândia, Suécia, União Europeia, Estados Unidos e Brasil relativamente ao afluxo de migrantes ambientais.

THE INTERNATIONAL PROTECTION OF ENVIRONMENTAL MIGRANTS
ABSTRACT: This article aims to analyze the legal protection regime applicable to the situation of individuals who migrate due to environmental factors and the adequateness of such regime. In order to do so, we will evaluate the applicable conventional and customary norms of international human rights law, through a study of international tribunals’ jurisprudence, as well as the specific measures taken by Finland, Sweden, the European Union, the United States, and Brazil before influxes of environmental migrants.
