A positivação da análise de impacto regulatório no Brasil: um exame da Lei nº 13.874/2019 e do Decreto nº 10.411/2020

Resumo
A análise de impacto regulatório (AIR) subsidia decisões regulatórias com base em evidências e permite avaliar potenciais efeitos de atos normativos antes de sua edição ou revisão. Embora amplamente recomendada pela OCDE, sua obrigatoriedade no Brasil ocorreu apenas quando o Decreto nº 10.411/2020 (Decreto da AIR) regulamentou o art. 6º da Lei nº 13.848/2019 (Lei geral das agências reguladoras federais) e o art. 5º da Lei nº 13.874/2019 (Lei da liberdade econômica (LLE)), o qual dispõe sobre a obrigatoriedade de a Administração Pública federal realizar AIR. Para analisar sua positivação no País, este estudo centra-se nas discussões que moldaram o Decreto da AIR e o art. 5º da LLE – em especial, as hipóteses de inaplicabilidade e dispensa de AIR. Com abordagem qualitativa, método hipotético-dedutivo e revisão bibliográfica e documental, a pesquisa sugere que a atual redação dessas normas fragiliza a aplicação da AIR ao permitirem interpretações amplas e pouco objetivas.

The Institutionalisation of Regulatory Impact Analysis in Brazil: An Examination of Law n. 13,874/2019 and Decree n. 10,411/2020
Regulatory Impact Analysis (RIA) supports evidence-based regulatory decisions and allows for the assessment of potential effects of normative acts before their enactment or revision. Although widely recommended by the OECD, its mandatory implementation in Brazil only occurred when Decree n. 10,411/2020 (RIA Decree) regulated Article 6 of Law n. 13,848/2019 (General Law of Federal Regulatory Agencies) and Article 5 of Law n. 13,874/2019 (Economic Freedom Law (EFL)), which provides for the obligation of the federal Public Administration to carry out RIA. To analyse its implementation in Brazil, this study focuses on the discussions that shaped the RIA Decree and Article 5 of the EFL—especially the hypotheses of inapplicability and exemption from RIA. Using a qualitative approach, a hypothetical-deductive method, and a bibliographic and documentary review, the research suggests that the current wording of these regulations weakens the application of RIA by allowing for broad and not very objective interpretations.
