Resumo
Com base na intersecção de gênero, raça e classe, o artigo analisa as barreiras estruturais enfrentadas por mulheres negras no mercado de trabalho brasileiro. Levanta a hipótese de que sua exclusão não decorre de limitações individuais, mas da reprodução histórica de mecanismos institucionais de discriminação, e investiga a persistência dessas barreiras e as estratégias normativas, políticas e sociais que podem superá-las. O estudo adota abordagem dogmática, método dedutivo e procedimento jurídico-teórico, com análise qualitativa de dados secundários oficiais, além de revisão bibliográfica e documental. Os resultados revelam que a divisão sexual e racial do trabalho relegou mulheres negras a funções desvalorizadas – e que persistem as disparidades salariais, a informalidade, a sobrecarga de cuidados, a exclusão de cargos de liderança. As normas têm uma limitada efetividade devida à ausência de políticas interseccionais. O artigo sustenta a necessidade de se implantarem ações afirmativas, de se revisarem critérios de mérito e de se formularem políticas públicas decoloniais com o fim de se garantir a justiça social.

From the Invisible to the Inevitable: Overcoming Structural Barriers for Black Women at Work
Based on the intersection of gender, race, and class, this article analyses the structural barriers faced by Black women in the Brazilian labour market. It hypothesises that their exclusion does not stem from individual limitations, but from the historical reproduction of institutional mechanisms of discrimination, and investigates the persistence of these barriers and the normative, political, and social strategies that can overcome them. The study adopts a dogmatic approach, a deductive method, and a legal-theoretical procedure, with qualitative analysis of official secondary data, in addition to bibliographic and documentary review. The results reveal that the sexual and racial division of labour has relegated Black women to devalued roles—and that wage disparities, informality, caregiving burden, and exclusion from leadership positions persist. The norms have limited effectiveness due to the absence of intersectional policies. The article argues for the need to implement affirmative action, revise merit criteria, and formulate decolonial public policies in order to guarantee social justice.
