Resumo
A Europa está lidando com a maior onda de requerentes de refúgio desde a Segunda Guerra Mundial. A União Europeia adotou medidas para ajustar sua política comum à nova realidade, medidas que estariam em consonância com o regime jurídico internacional de proteção aos refugiados. Sua implementação tem enfrentado resistência por parte de alguns Estados-membros, especialmente os países do Grupo de Visegrado. O objeto deste estudo é examinar em que medida esses países podem, em situação de fluxos extraordinários de refugiados e migrantes econômicos para Estados que integram uma área de livre circulação de pessoas, adotar políticas restritivas de ingresso e permanência em seu território, sem que isso afete sua conformidade com o regime de proteção aos refugiados e o regime de direitos humanos.

TESTING THE LIMITS OF THE INTERNATIONAL LEGAL REGIME FOR REFUGEES: THE EUROPEAN CASE
ABSTRACT: Europe is dealing with the largest wave of refugee seekers that the continent has seen since World War II. The European Union has adopted measures to adjust its common policy to the new reality, measures that would be in line with the international legal regime for the protection of refugees. Their implementation has faced resistance on the part of some Member States, especially the countries of the Visegrad Group. The object of this study is to examine to what extent these countries can, in situations of extraordinary flows of refugees and economic migrants to States that participate in an area of free movement of persons, adopt restrictive policies of ingress and permanence in their territory, without affecting its compliance with the refugee protection regime and the human rights regime.
