O semipresidencialismo francês em xeque

Resumo
O artigo examina a peculiar leitura que o semipresidencialismo francês oferece ao princípio da separação de poderes e comenta a crítica de que estaria desequilibrado pela proeminência do presidente sobre o primeiro-ministro e pela liderança do Executivo nos trabalhos legislativos. Ao final, conclui que o problema da hiperpresidencialização do regime francês pode ser atenuado com o aumento da duração do mandato do presidente, com a definição mais precisa de suas atribuições e responsabilidades, com a introdução de uma componente proporcional na eleição para a Assembleia Nacional e com o reforço do papel da oposição no controle dos atos do Governo.

THE FRENCH SEMI-PRESIDENTIALISM IN CHECK
ABSTRACT: The article aims to examine the peculiar reading that the French regime gives to the Montesquieu’s separation of powers system. It comments the criticisms of semi-presidentialism that it would be unbalanced by the prominence of the president over the prime minister and the leadership of the Executive Power in legislative work. It concludes that the problem of “over-presidentialisation” can be mitigated by the increase in the president’s term of office, the definition of his duties and responsibilities, the introduction of the proportional component in the National Assembly election and the strengthening of the opposition’s role in the control of government acts.
