Resumo
Para além das formações teóricas relativas à atividade da jurisdição constitucional, a questão que este trabalho ressalta é a importância de se analisar também a estrutura e a configuração das instituições, sob o risco de que todo o processo normativo de aplicação e de justificação possa ser desprezado. Assim, pretende-se, com base na concepção de razão pública de John Rawls, analisar criticamente se a estrutura de julgamento e de construção do provimento no âmbito do Supremo Tribunal Federal (STF) é de fato legítima e se a instituição – órgão do poder Judiciário – possibilita a implementação do uso público da razão para a construção da razão pública.

THE PUBLIC REASON ACCORDING TO JOHN RAWLS AND THE LEGITIMATE CONSTRUCTION OF THE JUDICIAL PROCEDURE IN THE STF
ABSTRACT: The question in this paper points out is that despite the theoretical training with regard to the constitutional court activity, it is important that the structure and the configuration of the political institutions should also be analyzed, at the risk that the entire process of application and justification can be neglected. Thus, we intend to make a critical analysis from the John Rawls’ concept of public reason, to consider whether the trial structure and construction of the provision in the Brazilian STF is legitimate in fact and whether the institution – Judiciary organ – enables the implementation of the use of public reason for its construction.
